New York State has its own WARN Act (NY Labor Law Article 25-A), materially stricter than the federal law. Coverage applies to private employers with 50 or more full-time employees statewide, well below the federal 100-employee threshold. Plant closings affecting 25 or more employees, and mass layoffs of 25 or more employees representing at least 33% of site headcount (or 250 or more regardless of percentage), trigger the Act. Notice must go out 90 days in advance, 30 days longer than federal WARN, to affected employees, the NY Department of Labor, and Local Workforce Development Boards. A 2023 regulatory update distinguishes temporary layoffs (under six months, with a planned return) from permanent ones for notice-trigger purposes. New York City employers should build those dates into the notification calendar before it is set, and have counsel confirm current applicability to their facts.
